On June 16, 2010, Bernie Kurlemann was charged in federal court with not disclosing in the bankruptcy of Kurlemann Builders, Inc. an alleged oral option about the repurchase of a building lot. The sale of that lot was disclosed in the bankruptcy.
The charge does not say that the sale price of the lot financially harmed the creditors in any way. Also, the charge does not say what value, if any, the oral option had to the creditors.
Kurlemann Builders, Inc. has and will satisfy all its obligations in its pending bankruptcy proceeding.
Bernie Kurlemann will vigorously defend this unsupported accusation at trial because the law did not require Kurlemann Builders, Inc. or Bernie Kurlemann to disclose the alleged oral option in the bankruptcy.
An indictment is not evidence of guilt, and Bernie Kurlemann is innocent unless proven guilty beyond a reasonable doubt before a jury.
On January 29, 2010, Bernie Kurlemann will voluntarily appear in federal court and plead not guilty to the three charges in the indictment. He disputes the charges that he violated federal law.
The Kurlemann family of companies will continue building quality homes while fighting these untrue accusations. Over 22 years, the Kurlemann companies have built more than 300 homes in greater Cincinnati, and have added measureable value to the communities in which they build.
The Kurlemann companies will continue to provide work for the many subcontractors and suppliers who help Kurlemann build fine homes and who support their families by working with Kurlemann.
As the government states about these charges against Bernie Kurlemann, “An indictment is merely a formal charge by the grand jury. Each defendant is presumed innocent unless and until proven guilty in U.S. District Court.”
The indictment does not suggest that Bernie Kurlemann defrauded his customers, his suppliers, or his subcontractors.
The Kurlemann companies value their relationships with their customers—past, present, and future. If the buyers of these homes lied to their lenders to get mortgages, Bernie Kurlemann did not know that they lied.
Bernie Kurlemann did not knowingly make any false statement to influence the lender in these sales and did not conspire with anyone to do so.
